CryptixBot - Terms of Service

1 Agreement to Terms

By accessing or using CryptixBot ("the Service", "the Platform", "we", "us"), including creating an account, connecting a Binance API key, or activating a subscription, you ("the User", "you") agree to be legally bound by these Terms of Service. If you do not agree to any part of these Terms, you must not use the Service.

These Terms constitute the entire agreement between you and TurboPay Technologies Pvt. Ltd. regarding your use of CryptixBot. We reserve the right to update these Terms at any time. Continued use of the Service after changes have been posted constitutes your acceptance of the revised Terms.

2 Service Description

CryptixBot is a SaaS (Software-as-a-Service) platform that provides an automated cryptocurrency grid trading bot. The Service connects to your Binance spot trading account via an API key that you provide, and executes buy and sell orders on your behalf according to a pre-configured grid trading strategy.

The bot operates 24 hours a day, 7 days a week on servers managed by TurboPay Technologies Pvt. Ltd.
Trading is conducted exclusively on your own Binance account. All funds and assets remain on Binance at all times.
The Service offers multiple performance levels (Level 1 through Level 5), each using different combinations of technical indicators and risk parameters.
Features include a live dashboard, Telegram trade alerts, P&L tracking, and automated risk management.
The Service is provided "as-is" and may be updated, modified, or discontinued at any time.

3 Not Financial Advice - Risk Disclosure

CryptixBot is not a financial advisor. Nothing on this platform constitutes investment advice, financial advice, trading advice, or any other form of professional advice.

All trading involves substantial risk of financial loss. By using CryptixBot you explicitly acknowledge and accept the following:

Past performance of the bot does not guarantee future results. Historical returns shown are indicative only.
You may lose all of your invested capital. Automated trading strategies can result in partial or total loss of your trading funds.
Never invest money you cannot afford to lose. Only use funds that you are fully prepared to lose entirely.
Grid trading strategies perform best in sideways or ranging markets and may underperform significantly during strong trending or crashing market conditions.
Cryptocurrency markets are highly volatile, operate 24/7, and are subject to rapid and unpredictable price movements.
You are solely and entirely responsible for all trading decisions and outcomes. CryptixBot merely executes a predefined algorithm on your behalf.

You are strongly encouraged to consult a qualified financial advisor before committing any capital to automated trading.

4 API Security & Fund Custody

We take the security of your credentials and the protection of your funds extremely seriously. The following guarantees apply to all users of the Service:

We use read-only-equivalent API access for trading only. We request only "Spot & Margin Trading" permissions from Binance. We never request, and your API key must never be configured with, withdrawal permissions.
We cannot withdraw or transfer your funds. Even with a trading API key, Binance requires a separate withdrawal permission that we explicitly do not request. It is structurally impossible for us to move your funds off Binance.
Your assets remain on Binance at all times. CryptixBot never holds, moves, or takes custody of any cryptocurrency or fiat currency.
We never have custody of your funds. CryptixBot is not a wallet, exchange, or custodian. We are purely a software service that places orders via Binance's API.
Your API keys are encrypted with AES-256 before storage. Raw API keys are never logged, never transmitted in plaintext after submission, and are not recoverable in plaintext even by our engineering team.
You must immediately revoke your API key on Binance and notify us at admin@cryptixbot.com if you suspect any unauthorized access to your account.

5 User Responsibilities & Eligibility

You must be at least 18 years of age to use the Service. By registering, you confirm that you meet this requirement.
You are responsible for maintaining the security and confidentiality of your CryptixBot account credentials, including your password and any two-factor authentication (2FA) codes.
You are solely responsible for your Binance account, including its security settings, verification status, and compliance with Binance's own terms of service.
You must comply with all local laws applicable to you. It is your responsibility to determine whether using an automated cryptocurrency trading service is legal in your jurisdiction. The Service may not be used in countries where such activity is prohibited.
You are responsible for all taxes on trading profits in your jurisdiction. CryptixBot does not provide tax advice. You should consult a qualified tax professional regarding your obligations.
You are responsible for ensuring your Binance account has sufficient funds and that the API key you provide is valid and correctly configured.

6 Subscription & Payments

All subscriptions are prepaid. Access to the Service begins upon payment confirmation and activation by our team.
Subscription fees are non-refundable once the bot has been activated for your account. If your payment has been confirmed and the bot is running, no refunds will be issued for the remaining subscription period.
The Starter plan ($1 for 7 days) is a one-time charge and does not auto-renew. Monthly and annual plans require manual renewal.
We accept payments via Cryptocurrency (Bitcoin, Ethereum, USDT, and others), UPI (where available), and PayPal (where available). UPI payments are verified manually within 24 hours of submission.
TurboPay Technologies Pvt. Ltd. reserves the right to change pricing at any time with at least 30 days' notice to existing subscribers.
Subscriptions expire at the end of their paid period. Bot activity is automatically paused upon expiry.
In the event of a technical failure on our part that prevents the bot from operating for an extended period, we may, at our sole discretion, offer a subscription extension. This is not a guaranteed remedy.

7 Data Collection & Privacy

We collect the following information when you register and use the Service:

Account data: email address, username, phone number, and country of residence.
API credentials: your Binance API key and secret, which are encrypted with AES-256 immediately upon submission and stored only in encrypted form.
Usage data: bot activity logs, trade history, P&L records, and login activity for the purpose of providing and improving the Service.
Referral data: referral codes used at registration, where applicable.

We do not sell, rent, or trade your personally identifiable information to third parties. We may use anonymized, aggregated data (e.g., average returns across all users, trading volume statistics) for internal analysis or marketing purposes, in a form that cannot be used to identify you.

8 Prohibited Uses

You agree not to use the Service for any of the following purposes:

Any illegal activity, fraud, money laundering, or financing of terrorism.
Market manipulation, wash trading, spoofing, or any other activity that violates Binance's Terms of Service or applicable financial regulations.
Attempting to reverse engineer, decompile, copy, reproduce, resell, or sublicense any part of the CryptixBot platform, codebase, or infrastructure.
Sharing your account credentials with unauthorized third parties or allowing others to use your account.
Abusive, threatening, or harassing behavior toward our team or other users.
Attempting to interfere with, disrupt, or gain unauthorized access to the Service or its underlying systems.

Violation of these prohibitions may result in immediate account termination without refund.

9 Limitation of Liability

To the maximum extent permitted by applicable law, TurboPay Technologies Pvt. Ltd. and its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

Trading losses of any kind resulting from bot activity, market movements, or strategy underperformance.
Losses caused by Binance downtime, exchange maintenance, API rate limiting, or Binance account suspension.
Losses caused by API failures, incorrect API key configuration, insufficient account balance, or trading permission errors.
Losses caused by service interruptions, server outages, maintenance windows, or technical failures on our infrastructure.
Any other financial loss arising from your use of or inability to use the Service, even if we have been advised of the possibility of such loss.

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantee of any specific trading return or profit.

Our total aggregate liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the total subscription fees you paid to us in the 30 days preceding the claim.

10 Service Availability

We aim for high uptime but do not guarantee uninterrupted or error-free access to the Service. Scheduled maintenance, infrastructure upgrades, exchange API changes, or unforeseen technical failures may temporarily affect bot operation. We will endeavour to provide advance notice of planned maintenance where possible.

We are not liable for any trading losses or missed opportunities caused by service downtime or interruptions, regardless of cause.

11 Termination

You may cancel your subscription at any time by contacting support. Access continues until the end of the current paid period.

We reserve the right to suspend or permanently terminate your account at our discretion if you violate these Terms, engage in prohibited activity, provide false registration information, or for any other reason with reasonable notice where practicable. Termination for cause (e.g., fraud, Terms violation) may result in immediate suspension without refund.

12 Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of India.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
